1. Introduction
1.1 Eldrick Wayne Louey trading as CheckedOS (ABN 37 191 973 393) (we, us, our) operates, an artificial intelligence-assisted dashboard for real estate professionals (the Platform), and the website at www.checkedos.com (the Website).
1.2 The Platform organises information that a Subscriber already holds: calendar entries, email correspondence, goals, targets and notes of the Subscriber, and presents that information in a single interface. It identifies the Subscriber’s commitments for the day, the correspondence awaiting a response, and the activity required to meet the targets the Subscriber has set.
1.3 This Policy sets out the Personal Information we handle in operating the Platform, the purposes for which we handle it, and the limits we place on its use.
1.4 The Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs) establish the standards for the handling of personal information in Australia. Information concerning the APPs is available from the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.
2. Application of this Policy
2.1 This Policy describes how we handle Personal Information relating to:
- (a) real estate agents and agencies that subscribe to the Platform, and their authorised users (Subscribers);
- (b) clients and prospective clients of a Subscriber whose information the Subscriber enters into, or connects to, the Platform (End Clients); and
- (c) other individuals whose information is present in a Subscriber’s connected accounts, including but not limited to, conveyancers, building inspectors, other agents, suppliers and personal contacts (Third Party Contacts).
2.2 Personal Information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether or not the information or opinion is true and whether or not it is recorded in a material form.
3. Information we collect and hold
3.1 (Subscriber information) In establishing and administering a Subscriber account, we collect and hold:
- (a) name, business name, ABN or ACN, email address, telephone number and login credentials;
- (b) billing information (payment card details are processed by our payment provider and are not stored by us);
- (c) the goals, targets, tasks and notes recorded in the Platform by the Subscriber; and
- (d) information concerning use of the Platform, which we use for support and diagnostic purposes.
3.2 (Connected account information) Where a Subscriber connects a Google account, we access information held in that account in the manner described in section 4.
3.3 (End Client and Third Party Contact information) We do not collect this information directly from End Clients or Third Party Contacts. It is provided to us in one of two ways: a Subscriber enters it into the Platform, or it is present in an account that the Subscriber connects. Depending on the nature of the Subscriber’s business, it may include names, contact details, property information, financial information and identification documents.
3.4 (Website information) When a person visits the Website, we automatically collect technical information, including IP address, browser type, device identifiers and the pages viewed.
3.5 (Sensitive information) We do not request sensitive information (as that term is defined in the Privacy Act), and the Platform is not designed to collect it. As the Platform accesses connected email accounts, sensitive information may nevertheless be present in the material we handle. We do not use sensitive information to categorise or target any individual, or to form any assessment concerning any individual.
4. Connected Google accounts
4.1 The Platform operates by connecting to a Subscriber’s Google account. On connection, the Subscriber authorises us to access their email and calendar through Google’s application programming interfaces. We request only those permissions required for the Platform to function.
4.2 We use that access to:
- (a) display the Subscriber’s schedule;
- (b) identify correspondence awaiting a response and present it in order of priority;
- (c) prepare suggested draft responses for the Subscriber’s review; and
- (d) measure the Subscriber’s activity against the goals and targets recorded in the Platform.
4.3 (Limited Use) Our use of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements. In particular, we do not:
- (a) use or transfer Google user data to develop, improve or train any generalised or non-personalised artificial intelligence or machine learning model;
- (b) use Google user data for advertising purposes, or serve advertising within the Platform;
- (c) sell Google user data, or transfer it to any third party other than as required to provide the functions described in clause 4.2, to comply with applicable law, or in connection with a merger or sale of our business on notice to affected Subscribers; or
- (d) permit our personnel to read Google user data, except with the Subscriber’s express permission, where necessary for security purposes, where required by law, or where the data has been aggregated and de-identified.
4.4 We do not create a permanent copy of a Subscriber’s mailbox, calendar or contacts. We retain Google user data only for so long as is necessary to provide the functions described in clause 4.2, and in any event for no longer than 7 years.
4.5 A Subscriber may disconnect their Google account at any time from within the Platform, or revoke our access. On disconnection, we delete the Google user data we hold within 30 days.
5. Artificial intelligence
5.1 The Platform uses third party artificial intelligence services, currently Anthropic PBC, to summarise, organise and draft. Information is transmitted to that service in order to generate a response, which is returned to the Subscriber’s account.
5.2 We do not use any information provided or connected by a Subscriber including email correspondence, calendar entries, notes and goals, and End Client information to train, fine-tune or otherwise improve any artificial intelligence or machine learning model.
5.3 The Platform does not apply information derived from one Subscriber to any other Subscriber. Platform outputs are generated from the Subscriber’s own information.
6. Use of Personal Information
6.1 We use Personal Information to:
- (a) provide, operate and support the Platform;
- (b) establish and administer Subscriber accounts, process payment, and communicate with Subscribers concerning the service;
- (c) respond to enquiries and provide support;
- (d) maintain the security of the Platform and diagnose faults;
- (e) issue service communications, including security alerts and administrative notices; and
- (f) comply with applicable law and enforce our agreements.
6.2 We will use Personal Information for a secondary purpose only where that purpose is related to the purpose of collection and would be within reasonable expectation, where consent has been given, or where the law requires or permits it.
6.3 (Automated processing) The Platform applies automated processing to sort, summarise and prioritise information and to generate suggestions. It does not make decisions concerning any individual. All decisions concerning an End Client, including decisions relating to a sale, a listing, a tenancy or the provision of any service, are made by the Subscriber. The Platform must not be relied upon as the sole basis for any such decision.
6.4 We do not use End Client or Third Party Contact information for our own marketing purposes, and we do not communicate directly with End Clients or Third Party Contacts.
7. Disclosure of Personal Information
7.1 We disclose Personal Information to:
- (a) our artificial intelligence provider, currently Anthropic, which processes information in order to generate Platform outputs;
- (b) our payment provider, Stripe, for subscription billing;
- (c) professional advisers, including our lawyers and accountants, where required for the conduct of our business;
- (d) regulators, courts and law enforcement agencies, where required or authorised by law, or where we reasonably believe disclosure is necessary to prevent a serious threat to the life, health or safety of any person; and
- (e) an acquirer, in connection with a sale or merger of our business, on condition that the acquirer handles the information consistently with this Policy.
7.2 We do not sell Personal Information.
8. Overseas disclosure
8.1 Certain of our service providers are located outside Australia. Anthropic is located in the United States.
8.2 Before disclosing Personal Information to an overseas recipient, we take reasonable steps to satisfy ourselves that the recipient will handle the information appropriately, including by means of contractual protections.
9. Subscriber obligations
9.1 Subscribers determine what information is entered into the Platform and which accounts are connected. Subscribers must:
- (a) hold the right to provide the information they enter or connect;
- (b) disclose in their own privacy policy or collection notice that they use third party artificial intelligence-assisted tools such as the Platform, and obtain any consent required;
- (c) maintain the security of their login credentials, and notify us promptly if they suspect unauthorised access to their account; and
- (d) comply with their own legal obligations, which may include obligations under the Privacy Act, the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth), and real estate licensing legislation in their State or Territory.
9.2 Where a Subscriber’s connected account holds material that ought not be processed by a third party service, including material relating to a suspicious matter report, the Subscriber is responsible for excluding that material from the Platform.
9.3 An End Client or Third Party Contact seeking access to or correction of their information, or wishing to make a complaint concerning its handling, should contact the relevant Subscriber in the first instance. We will assist the Subscriber where we are able to do so.
10. Security
10.1 We take reasonable technical and organisational steps to protect Personal Information from misuse, interference and loss, and from unauthorised access, modification and disclosure. Those measures include encryption in transit and at rest and access controls.
10.2 Subscribers are responsible for maintaining the security of their own credentials.
10.3 Where a data breach occurs that is likely to result in serious harm, we will notify affected Subscribers promptly and, where the Notifiable Data Breaches scheme applies, notify the OAIC.
11. Retention and destruction
11.1 We retain Personal Information only for so long as it is required for the purposes described in this Policy, or for so long as the law requires.
11.2 Where Personal Information is no longer required, we take reasonable steps to destroy it or to de-identify it securely.
11.3 A Subscriber may request deletion of the information held in their account at any time. We will action such a request within 30 days, subject to any legal obligation to retain the information.
12. Website and cookies
12.1 The Website uses strictly necessary cookies, which are required for its operation, and analytics cookies, which collect aggregated information concerning use of the Website.
12.2 Cookies may be disabled through browser settings, although disabling strictly necessary cookies may impair the operation of the Website. The Platform does not rely on Website cookies for its core functionality.
12.3 We do not use advertising or targeting cookies.
13. Access, correction and complaints
13.1 A person may request access to the Personal Information we hold about them, and may request its correction where it is inaccurate, incomplete or out of date. Requests should be made using the contact details in section 14. We may require verification of identity, and we will respond within 30 days.
13.2 No charge applies to the making of a request. Where the provision of access involves substantial work, we may charge a reasonable administrative fee, and we will advise the amount before proceeding.
13.3 Where we are unable to provide access or to make a correction, we will provide written reasons.
13.4 A person dissatisfied with our handling of their Personal Information should contact us using the details in section 14. We will acknowledge a complaint within 10 business days and seek to resolve it within 30 days.
